Overview

The Council is committed to complying with the Code of Practice and the Data Protection Act 2018, ensuring that the public is kept informed and consulted on future developments of the system.

Â鶹ÊÓƵ is registered with the Data Protection Commissioner for its Central Control Unit CCTV operations and will abide by the constraints laid down within the Data Protection Act 2018.

CCTV in South Tyneside

The Council manages CCTV in its town centres, high streets, heavily congested roads, accident black spots, housing estates and some small shopping parades.

Nexus has ownership of the Metro system cameras.

The systems are active 365 days a year 24 hours a day.

Why have CCTV

  • To deter and detect criminal activity
  • To identify suspects
  • To gather evidence
  • To gather intelligence on suspects
  • To aid in prosecutions
  • To monitor anti-social behaviour and acts or events which endanger the public and Employees' health and safety
  • To assist the emergency services
  • Traffic management and assisting the Town Centre Manager in the day-to-day operations of the town centre

No sound recording facility is used in any public area. All recorded images will be kept for 30 days and are strictly controlled within the council procedures. Only authorised people will have access to the images.

Disclosure of CCTV images

CCTV images can be disclosed to:

  • Law enforcement agencies 
  • Prosecution agencies
  • Relevant legal representatives
  • The media 
  • People whose images have been recorded and retained

CCTV images will be disclosed for a number of reasons.

Images will be shared with law enforcement when the images recorded would assist in a criminal enquiry.

Images will be shared with the media where it is needed to identify a victim, witness or perpetrator in a criminal incident. The wishes of the victim of the incident will be taken into account. In all cases of media disclosure, the police will have discretion of disclosure.  

Images will not be disclosed to the people included in instances where disclosure to the individual would impact criminal enquiries or criminal proceedings, or in instances where an individual has been unable to provide a time, place and date by which the data controller can conduct a data search.

In any instance where the individual making the request is unknown to the data controller then it is a requirement that the individual provides a suitable photograph of himself/herself so that an accurate identification of the individual can be made within the recorded data.

How to apply to see an image

If you are the subject on the image, you must make your request to the Information Governance Team.

In dealing with the application for disclosure the designated manager will consider, prior to any disclosure, whether the images of third parties are held under a duty of confidence (First and Sixth Data Protection Principle). In this instance the identities of other individuals whose identifying features appear within the recorded data will have their images blurred so as to protect their identity. The data controller can make a charge should this editing be required. Details of these costs will be notified to the applicant once the data controller has completed a successful data search.

Please try and supply a map highlighting the exact location, description of person (with clothing or vehicles involved, including registrations), date and approximate time.

Half an hour prior to and after the times given will also be checked to avoid any discrepancies.
