Public Spaces Protection Orders: Taking psychoactive substances in public spaces (HTML)
Notice is hereby given that Â鶹ÊÓƵ in its exercise under section 59 and 60 of the Anti -social Crime and Policing Act 2014 ("the Act") proposes to make the following Order:
Â鶹ÊÓƵ Public Spaces Protection Order - Number 3 of 2021
- The Order shall come into operation on 17 May 2024 and shall have effect for a period of three years thereafter unless extended by further orders under Â鶹ÊÓƵ's (hereinafter the Council) statutory powers.
- The Order relates to the area outlined in red on the attached plan (marked Area A) for the purpose of this Order the 'Restricted Area' includes public land within the Borough of South Tyneside.
- The effect of the Order is to continue to prohibit the use of psychoactive substances in the restricted areas.
- The Council is satisfied that the conditions set out in Section 59, 64 and 72 of the Act have been satisfied and that is in all the circumstances expedient to make this Order to reduce the detrimental effect or to reduce the risk of crime and anti-social behaviour and its continuance, occurrence, or reoccurrence in the Restricted Area, which has a detrimental effect on the quality of life of those in the locality. The effect or likely effect of this is persistence or continuing nature such as to make this unreasonable, and justified the reasons imposed by this Order.
- A person who fails to without reasonable excuse to comply with a requirement or adhere to a prohibition imposed on him or her by the Order commits an offence and is liable on summary conviction to a fine exceeding level 3 on the standard scale.
- A Constable or authorised person may issue a fixed penalty notice to anyone he or she has reason to believe has committed an offence under Section 63 or 67 of the Anti-Social Behaviour and Policing Act 2014.
- If any interested person desires to question the validity of this Order on the grounds that the Council had no power to make it or that any requirement of the Act has not been complied with in relation to this Order he or she may apply to the High Court within six weeks from the date on which this Order is made.
